Caspary reports on Australia, New Zealand FTAs: do separate investment deals

The European Parliament’s draft recommendations for the coming Australia and New Zealand free trade negotiations contain for the first time concrete recommendations on how to structure the EU’s commercial agreements after the European Court of Justice ruling on the Singapore FTA in May 2017 which said investor state disputes are not an exclusive EU competence.
